This is NOT an exclusive contract. Artist may sell their original work(s) through any other channel.

In furtherance of this objective, in exchange for :

10 000.01 to 100 000.00 - 15% Fee to www.artmart.cc
100 000.01 to 500 000.00 - 10% Fee to www.artmart.cc
500 000.01 to 1 000 000.00 - 8% Fee to www.artmart.cc
1 000 000.01 to 2 000 000.00 - 6% Fee to www.artmart.cc
2 000 000.01 to 5 000 000.00 - 4% Fee to www.artmart.cc
5 000 000.01 and up              - 2% Fee to www.artmart.cc
Level of the total sold items less agreed shipping and insurance costs, ArtMart.cc and the artist agree as follows:

1. www.ArtMart.cc will act as an intermediary for the sale of artwork via the following web sites: www.ArtMart.cc and additional sites that have been agreed upon:

3. www.ArtMart.cc will act as an intermediary between the artist or art owners and the Artist's, art owner buyer. The artist or buyer may not be a minor. For Minors Parental agreement and participation is required.
4. Any sale shall take place between the artist and the buyer or art owner and buyer. All credit card or check sales shall be denominated in United States Dollars.
5. The agreed purchase price of the art, including agreed shipping and insurance, shall be paid to Silesia Group Inc. by the buyer, prior to shipping.
6. www.ArtMart.cc will accept payment from the buyer in United States currency, or EURO (for bank transfers), or by appropriate charge/ debit (Visa, Mastercard, American Express, Discovery card), in an equivalent amount to the U.S. Dollar sales figure.
7. Artwork shipping, including appropriate insurance is and remains the responsibility of the Artist or art owner.
8. Upon receipt of the artwork by the buyer, the artist's buyer shall have three (3) days to reject the work. Here, the artist shall notify www.ArtMart.cc and buyer of the shipping date within 24 hours of actual shipping, said notice to include a shipping tracking number. It is agreed by the artist / art owner herein, that absent actual notification, receipt by the buyer shall be assumed to be no longer than twenty one (21) days unless agreed upon in writing.
9. If the artwork is rejected by the buyer, www.ArtMart.cc will hold any payment by the buyer until notified by the Artist / Art Owner that the artwork has been received back, by the Artist / Art Owner. Alternatively, where www.ArtMart.cc is notified by the buyer of delivery as evidenced by a signed return receipt, e-mail or tracking notification, and the Artist / Art Owner fails to confirm receipt, in answer to a www.ArtMart.cc notification, for a period of at least thirty (30) days. Following receipt or constructive receipt, as outlined herein, www.ArtMart.cc will return the buyer's payment.
10. If the artwork is accepted, www.ArtMart.cc will make payment to the Artist / Art Owner during the first week of the month, first following acceptance of the artwork, acceptance being as outlined above. Payment to the artist shall be the full amount as deposited by the buyer (purchase price plus agreed shipping and insurance costs), minus www.artmart.cc fee at level below:

1.   less of the purchase price to www.artmart.cc for providing this service.
2. In the event any payment has stopped for any reason, www.artmart.cc shall not be held responsible for said stop payment, by either the artist, art owner or the art buyer. Any remedies for www.artmart.cc against either the buyer or the seller shall be preserved however, any action for payment or recovery of artwork as and between the buyer and the seller shall remain the sole responsibility of said buyer or said artist seller or art owner.
3. In requesting that www.artmart.cc undertake this service for the Artist / Art Owner, and the Art buyer, the Artist agrees as follows:

1. www.artmart.cc is not, in so acting, the agent, representative, broker, or employee of the Artist / Art Owner or the Artist's / Art Owner buyer.
2. www.artmart.cc assumes no responsibility or liability for any part of delivery, insurance, cost of delivery, customs fees, recovery etc.
3. The Artist / Art Owner agrees that the artwork sold or transferred to the buyer, is that Artist's original works, and further agrees not to act as an agent, representative, broker or employee for any other artist , art owner utilizing this service with www.artmart.cc.
4. The Artist, Art Owner understands and agrees, that www.artmart.cc is not an importer or exporter, nor is www.artmart.cc an art dealer, or merchant in international or interstate commerce. Further, the Artist, Art Owner assumes all risk of loss resulting from shipping, delivery, confiscation, damage etc.
5. The Artist understands and agrees that www.artmart.cc may reject or refuse to undertake any transaction or request to act as outlined herein, for any reason. Upon accepting a transaction or request, the full extent of www.artmart.cc' responsibility is and shall be limited to the express duties as set out herein.
6. The Artist, Art Owner agrees to keep all information up to date and accurate and further warrants the work to be original, and not subject to any copyright infringement, or criminal activity.

 

The parties hereto agree, that in the event of any dispute arising from this contract, the dispute shall be submitted to arbitration, in Pasco County, Florida, USA, within one (1) year from the date of the event from which the dispute arises, as outlined by the laws of the State of Florida, and any action after said time is herein and hereby precluded. Arbitration as outlined herein, shall be the exclusive remedy of either party to the dispute, and the results thereof shall be binding on all parties. www.artmart.cc' liability in any case, shall be limited by this contract, and shall in no case, be greater than one hundred percent (100%) of the purchase price.
